FTC and ASA Disclosure Requirements for Affiliate Marketers
The US FTC (Federal Trade Commission), UK ASA and India's ASCI all require clear disclosure when you earn money for recommending products — affiliate links, sponsored content, gifted products or paid partnerships. Inadequate disclosure can result in fines and loss of affiliate program access. The disclosure must be clear, conspicuous (visible before clicking a link) and in plain language. Our generator creates compliant disclosures for blogs, YouTube, Instagram and newsletters.
Frequently Asked Questions
Where exactly should an affiliate disclosure appear on a blog post? ▼
Per FTC guidelines: the disclosure must be clear and conspicuous — meaning it must be visible BEFORE the reader encounters the affiliate links. Best practice: at the very beginning of the article, before the first affiliate link. Do NOT hide it in the footer, about page or after all links. Use a clearly visible text box or banner.
What are the ASCI guidelines for affiliate marketing disclosure in India? ▼
India's ASCI (Advertising Standards Council of India) guidelines (updated 2021) require all influencers and affiliate marketers to clearly label paid/affiliate content with #ad, #sponsored or #collab. The disclosure must be in the same language as the content and must be prominently placed — not hidden in hashtags or small print at the end.
What is the difference between #ad and #sponsored? ▼
#ad: you received payment (money) for the promotion. #sponsored: the content was directly commissioned by a brand (brand paid you to create it). Both require disclosure. For affiliate links where you earn commission only if someone buys: use "Affiliate Disclosure" or #affiliate. All three require FTC/ASCI disclosure.
Does an affiliate disclosure need to be on every page or just the privacy policy? ▼
Every piece of content containing affiliate links needs its own disclosure visible before the links. A blanket disclosure on your Privacy Policy page is NOT sufficient. YouTube videos need verbal disclosure AND a text card within the first 30 seconds. Instagram posts need #ad in the first line of caption, not buried in hashtags.
